Two Department of Homeland Security (DHS) special agents in Utah have been accused of a shocking breach of public trust, involving the illegal sale of seized drugs. Agents David Cole and Nicholas Kindle are alleged to have conspired to distribute synthetic drugs, commonly known as “bath salts,” which were stolen from evidence lockers. These drugs were reportedly sold through a confidential informant, who then resold them on the streets of Utah. The illicit scheme allegedly generated profits ranging between $195,000 and $300,000. In addition to the drugs, the DHS agents are accused of stealing cash, a diamond ring, and even a Peruvian antiquity from the evidence vault.

The alleged misconduct came to light when a lawyer for the informant contacted federal prosecutors in late 2024, raising concerns about the agents’ actions. According to reports, the agents compelled the informant to engage in unlawful activities under the guise of legitimate investigations. The FBI launched an investigation, uncovering evidence of the agents’ involvement in the drug distribution ring. Both Cole and Kindle have been suspended from their duties, but they have not yet been dismissed. Cole has pleaded not guilty, with his trial scheduled for February 2025, while Kindle’s court proceedings are set to begin later in January.

If convicted, the agents could face severe legal consequences. Cole may receive a sentence of up to 20 years in prison, while Kindle faces up to 25 years. The scandal has drawn significant criticism, highlighting the potential for abuse within federal law enforcement agencies like the DHS. The case underscores the critical need for oversight and accountability in agencies tasked with upholding the law and protecting public safety.
